The date was August 31st, the day after would be September 1st. A date which was of only minor significance in most people's eyes. But most people weren't a Wizard, most people didn't attend Hogwarts School of Witchcraft and Wizardry. Thorpe couldn't wait to return for his fourth year at the school. Normal life bored him. Both of his parents were Muggles and he wasn't allowed to do magic outside of school so the holidays always seemed long and drawn out for the young Gryffindor. Although, Thorpe got bored incredibly easily because at home he had no friends or siblings to show off to, and his parents both worked long hours so they couldn't make him the centre of attention.
The centre of attention was what Thorpe Smith knew he was born to be. He presumed that was why he'd been placed in Gryffindor, because if it meant being the centre of attention he would undertake any task that required a copious amount of bravery.
He'd bought his owl treats for his tawny owl, Oscar, so now Thorpe was trudging out of the shop. He was half way across the shop when an idea occured to him and he did something that was, in hindsight, remarkably idiotic.
He leaned over to the left slightly, checked that no one was looking and unhooked the latch on the door of a cage. Inside the cage was a haughty looking brown owl.
"Mr Vice, Sir!" He called, shouting the name of the shopkeeper. "Someone has left this ca..." That was when the creature inside, which was more intelligent than Thorpe had given it credit for, pushed open the cage door and flew out. This didn't really matter to Thorpe, it would gain him more attention if he caught the bird. If only someone hadn't seen him opening the cage, and that person chose that moment to speak up.

Kane also had an owl. Bee had black feathers and startling amber eyes. His grandfather had bought her as a present for Kane's tenth birthday from Eeylops and Kane regularly visited the shop to buy treats for his owl. Occasionaly he brought Bee in herself, to show the aging shopkeeper how she was doing. She was Kane Charleston's pride and joy. He wasn't a kind or particularly loving person, but he shared a bond with the bird that he knew he would never share with another being and he doted on her. He was looking through the shop door and into the owl emporium when he saw someone unlatching the door of a cage. Kane glared at the boy, who looked vaguely familiar to the Slytherin. He waited and watched, he heard the boy shouting to Mr Vice and he saw the bird open the cage door and fly out. "It was him!" Kane shouted. Marching into the shop and pointing at the boy, who he now recognised as a Gryffindor in the same year. {OOC: can NPC please roleplay as Mr Vice?}

(Mr. Reginald Vice) [/b] The aging wizard moved from around the counter with an agility that didn't match his years when he looked up upon hearing his name to see one of his prized owls escaping. The owls did escape from time to time but Reginald had moved so quickly because the door of the shop had opened. He didn't have time to see who it was, or to make sense of what they were shouting. "Shut the blasted door!" He cried, followed by, "Impedimenta!" and with a sharp flick of his wand the owl slowed in mid air. Unable to stay air-borne at such a slow speed it drifted slowly to the ground. The shop keeper scooped up the owl, which was moving too slowly to bite him, and placed it back in it's cage. He slammed the cage door shut and made sure the catch was fastened before turning around to face the 2 young men who were in his shop. He recognised both of them as frequent visitors to Eeylops, but he only knew one of them by name. "Master Charleston!" He exclaimed more than shouted, ignoring the other Hogwarts student. "Would you mind telling me what on earth is going on here?"

A combination of Kane's and Mr. Vice's quick reactions stopped the bird from leaving the emporium as Kane pushed the door shut as soon as the shopkeeper told him to. He watched silently as the older wizard sorted out the problem and a smug look spread across the face of the Slytherin.
"Well, Mr. Vice, this preposterous excuse for a Wizard opened the latch of the cage as he walked past. I recognise him from school, he's in some of my classes and I believe that his name is Thorpe. Thorpe Smith." Kane hoped that Thorpe would be in deep trouble, not only because he despised Gryffindor's but also because he had done something which could have caused injury to the owl.

It didn't look good for Thorpe and he realised this from the moment that Mr. Vice had spoken the other boys name in a manner that suggested they were slightly more than just acquaintances. He gulped as the other student, Kane, explained what had happened and he desperately tried to think of a way out of the situation. But, unfortunately, Thorpe wasn't the brightest spark and so no feasible plan came to mind.
"I didn't know it was me who'd unlocked the cage." He argued.

(Mr. Reginald Vice) The wizard listened patiently to the young Slytherin telling him what had occured and he watched the owl in the cage as it's movements gradually returned to their normal speed. He stared at the other boy, Thorpe Smith, and when his attempt to explain made no sense whatsoever the shopkeeper scoffed, "How on earth did you not know that it was you? Have you no control over your own actions? Explain yourself boy!" Thus far Reginald had managed to keep his temper underwraps, but he knew that if Mr. Smith didn't get out of his sight soon then something untoward may happen to the student.

Thorpe was struggling to find a way out of the situation that he now found himself in. And he knew that his explanation didn't really explain anything but he attempted to reply to the shopkeeper.
"I mean that I must have unlatched the cage by accident by say, knocking it with my elbow or my bag." He wanted to say that Kane was a liar but somehow he knew that if it came to it then Mr Vice would believe the Slytherin over him. "I do apologise but I must be on my way." He turned around and started heading towards the door, hoping that no one would stop him.

(Mr. Reginald Vice) [/b] 'Count to ten.' Reginald told himself as he heard how pathetic Thorpe's excuse was. 'One...two...three...four...five...si...' He grabbed the boys shoulder tightly as he attempted to leave. "You dare show your face in my shop again boy and I will not be held responsible for any 'accidents' that may occur whilst you are here." He loosened his grip slowly and then let go of the Hogwarts student. "Now, clear off!"

Thorpe flinched as he felt the man take hold of his shoulder. He didn't scare easily but the icy threat that Mr Vice made sent a chill down Thorpe's spine. He'd always assumed that the shopkeeper was a kind man but now he thought different.
'That shows what a rubbish judge of character I am!' He thought to himself.
As soon as he was unhanded Thorpe continued his walk towards the door. He wanted to run, but knew that running would only make him look like a coward and the Slytherin boy would undoubtedly enjoy that. He opened the door and left the emporium, knowing that he had been left off lightly.

After Kane had finished speaking and Thorpe spoke for the fist time the fourth year Slytherin stood glaring at him, trying to keep himself from grinning smugly. He was about to grab the Gryffindor himself when Mr Vice did so, and his lips curled at the corners a little as he couldn't fight the grin when he heard the shopkeeper threatening the boy.
But then Thorpe was released and he calmly left the shop and Kane's face fell.
"That's it?" The anger and disappointment was clear in his voice. "He could have killed that owl and you just let him stroll away! That's unjust!" But then Kane remembered who he was speaking to and he added the word, "Sir."
